Sidney Garber Jewelers, Inc. (“Sidney Garber”) will set, handle, clean and/or adapt, as relevant, (the “Works”) all diamonds or gemstones (“Gemstones”) based on the information given to Sidney Garber by you (the “Customer”) and based on the scope of work agreed with you. The Customer is responsible for representing the type, condition, and authenticity of the Gemstones provided. Sidney Garber is not responsible for verifying the type, authenticity, or condition of Gemstones provided for the Works. 

 

Although we will always seek to provide superior service, inevitably there may be situations in which there will be a loss or breakage of Gemstones or of other constituent parts of jewelry left with Sidney Garber by the Customer (“Other Materials”, together with Gemstones the “Customer Items”). The Customer understands and accepts that there is a slight possibility of loss or damage of the Customer Items provided to Sidney Garber. Loss or breakage of Customer Items once in Sidney Garber’s possession will not be covered for replacement by Sidney Garber.

 

You, the Customer, agree that there is reasonable risk involved in removing Gemstones from mountings and resetting Gemstones. By requesting Sidney Garber to undertake works on pre-existing mounted or set Gemstones, you agree that Sidney Garber shall have no liability to you nor any third party in relation to any stone damage due to stone flaws or existing stone cracks, chipping, flaws, or inclusions and you agree to hold harmless Sidney Garber in each case from any claim from any third party with respect to such stone damage. Similarly, in regards Other Materials, you, the Customer, agree that Sidney Garber shall have no liability to you in relation to any damage caused as a result of a patent or latent defect in the Other Materials or as a result of the Other Materials being other than as represented to Sidney Garber at the time handed over by you, and you agree to hold harmless Sidney Garber in each case from any claim from any third party with respect to such damage. Sidney Garber is not responsible for confirming the accuracy of the information provided by the Customer with respect to the authenticity of the Customer Items. 

 

You, the Customer, are responsible for having insurance for your Customer Items while they are in the possession of Sidney Garber. Such insurance shall at least cover the full value of the Customer Items and shall cover loss or damage to the items because of theft, fire or accident. It is strongly encouraged that a recent appraisal accompanies the Customer Items. Should the client not have insurance, Sidney Garber will not be liable for any loss or breakage.

 

Sidney Garber shall be responsible only for loss or damage to the Customer Items to the extent caused by Sidney Garber negligence or breach of contract from the time that Sidney Garber takes possession of the Customer Items.  In such circumstances, Sidney Garber will be responsible for losses which you suffer only to the extent that they are a foreseeable consequence to both you and Sidney Garber at the time we receive the Customer Items. Our liability in relation to any such loss will be limited to the commercial cost of our replacing the Customer Items with items which are as similar as we are reasonably able to find and you, the Customer, agree that in such circumstances sentimental value cannot be taken into consideration.

 

Bespoke commissioned pieces require a 50% deposit and cannot be exchanged, returned, or refunded. The deposit is valid for 12 months after completion of the piece. After this period, if item(s) have not been collected, a formal notification will be issued stating the item is the property of Sidney Garber Jewelers Inc. We will not be liable for any damage to stones or materials not supplied by Sidney Garber Jewelers.
